TERMS AND CONDITIONS

FUELS Promotion (FILLING NO YƸ DEEP PROMO-RELOADED) starts on 1st October, 2018 and ends on 23rd  December 2018. The promotion is organized by VIVO ENERGY GHANA LIMITED, exclusive distributors and marketers of Shell Branded Products.

  1. Acceptance of Terms of Use
    All participants warrant that they have read carefully and have fully understood these Terms and Conditions which are available at the Vivo Energy website www.vivoenergy.com and at the Retail Sites.
  2. Participants of the CONSUMER PROMO:
    The following are eligible to participate:
    • The FUELS Promo is open to all MOTORISTS.
    • VIVO ENERGY reserves the right to disqualify any motorist who is found to have breached any provision of the Terms and Conditions.
    • Directors, employees, agents, suppliers and contractors of VIVO ENERGY are not eligible to participate in the CONSUMER PROMO.
  3. How to Participate
    • Motorists who fill up with a minimum of GHS 80 and above get a coupon to enter a
      Bi-weekly draw. Motorists who get the coupon will dial *714*40# send Secret number Send  from all Networks to enter the bi-weekly draw
    • Motorists will not be charged for dialling to enter the draw
    • Motorists who fill up with a minimum of GHS80 also stand the chance to win free airtime instantly. Airtime instant win has over 90,000 prizes with both GHS5 and GHS2 offers.
    • Motorist are not to receive multiples of promotional scratch cards for purchases above GHC 80.00 at a time.
  4. Duration of Promo
    • The promotion will run for twelve (12) weeks from 1st  October, 2018 to  23rd December 2018
  5. Draws & Selection of Prize Winners
    • There will be 6 bi-weekly draws with Seven (7) branded Taxi Hyundai grand i10 cars as ultimate prizes to be won.
    • The winners will be notified by a message via an SMS and an additional phone call for big prizes such as  Cars, Motor bikes, 6 months & 3 months free fuel and 1 month free shopping vouchers
    • Free Fuels
      1. 6 months free fuel will be a total of GHC 4,200 for the 6 months
      2. 3 months free fuel will be a total of GHC 2,100 for the 3 months;
      3. 1 month free fuel will be a total of GHC 700 for the month
      4. 1 month free shopping will be worth GHS500 from Shell shops
    • All free fuels will be Shell FuelSave Super and Diesel
    • There will also be 50 selected site activations where motorists could win instant prizes once they buy GHS80 and above on the activation day.
    • The name of the winners may be announced by newspaper advertisement or published on the VIVO ENERGY website.
    • Selected winners of the big prizes(Car, Motor bikes, 6 months and 3 months free fuel will be mentioned in our LPM on radio)
    • Winners of 6 & 3 Months and 1 month Free Fuel prizes shall receive a Shell Card to be used to redeem their Free fuel for the period. 
    • Winners of GHS50 and GHS100 worth of fuel and GHS500 worth monthly shopping voucher will be directed to specific Shell stations of their choice to redeem their prizes.
  6. Categories of Prizes
    The promotion will reward motorists via a random selection during the draws.
  7. Bi-Weekly Draws
    • There will be six (6) bi-weekly draws. Winners of the bi-weekly draws are not eligible to win same prizes in subsequent draws till end of the promotion.
    • Bi-weekly draws for the ultimate prizes will be done on regional bases ( The caritas platform will be fed with only codes from regions specify for the week by Vivo Energy for the ultimate prizes)
    • Vivo Energy will define the country into 6 key regions for the purpose of the draw.
    • Distribution of the promo codes and serial numbers will be done based on  breakdown of the regions done by Vivo Energy and shared with stakeholders of the promo
    • Regional breakdown is as follows:
      • Greater Accra,
      • Tema
      • Kumasi ( Kumasi)
      • Northern Ghana ( Northern region, Upper West & Upper  East & Sunyani)
      • Eastern Belt (Eastern region and Volta region)
      • Central & Western region
  8. Each draw will have a minimum of 300 prizes to be rewarded to the motorist till the end of the promotion. Below are the Prize details:
  9. Availability and accessibility of information and Opt-out mechanism
    • All contact information for the participants of the CONSUMER PROMO shall be accessed through Hubtle GHANA
    • Interruption or early termination of the CONSUMER PROMO shall not release VIVO ENERGY from its obligation to give out already won prizes and execute other actions required, except for the cases when termination or interruption of the CONSUMER PROMO caused by actions or events which are not under VIVO ENERGY’S control.
    • VIVO ENERGY shall not release personal information about participants of the FUELS PROMO to any third persons unless required to do so by law or in order to comply with a directive of government entities with statutory power to do so and in accordance with the Terms and Conditions herein.
    • VIVO ENERGY will not enter into written negotiations or otherwise contract with participants of the CONSUMER PROMO other than in accordance with the Terms and Conditions or in accordance with the requirements of the current legislation of Ghana.
  10. General Terms for Prizes:
    • All prizes must be redeemed within 21 days of the publication of names of winners.
    • Central point of collection of prizes shall be at the VIVO ENERGY Head Office, Accra and other Regional offices in Kumasi and Takoradi, from Monday to Friday from 10:00 GMT till 17:00 GMT.
    • The winners will be contacted by SMS and additional phone calls for big prize winners such as Car, Motor bikes, 3 months & 6 months & 1 month free fuels and 1 month free shopping voucher. The winners must confirm by a national ID card that they are entitled to the prize and shall complete all the necessary documents provided by VIVO ENERGY.  All winners must provide identification documents in order to receive the prize.  Prizes may be received by a representative of the winner by proxy upon written confirmation from the winner.
    • By participating in the promotion, the winners agree that any of their data, including names, surnames, photos and video images, can be used by VIVO ENERGY for advertising purposes with no prior consent of the winner and free of charge.
    • All prizes that remain unclaimed within 21 days of the date of selection or publication of winners will be forfeited.
    • Decisions made by VIVO ENERGY will be final and without appeal. Prizes won are not transferable.
  11. Additional Terms for Vehicle Motor bike Prizes
    • VIVO ENERGY shall maintain branding on the vehicle for minimum 1 month after handing them over to winners.
    • The winners of the vehicles shall not de-brand the prize vehicles within one month from the date of receipt of prize vehicle.
    • The winners of the vehicles shall not sell or otherwise dispose or part with possession of the prize vehicles within one year from the date of receipt of prize vehicle.
    • Winners of vehicles shall be responsible for all other cost of running the vehicles including maintenance and fuel cost.
    • Winners of the vehicles shall provide all required documentation to change the ownership of the vehicle to the winner.
    • Winners of motor bike will be handed with all documents related to the motor bike.
    • Winners will be required to do registration and certification of the motorbike on their own with no support from Vivo Energy.
    • The motor bike after presentation to winners ceases to be a property of Vivo Energy.
  12. Limitation of liability
    • VIVO ENERGY accepts no responsibility whatsoever for, including without limitation, any error, omission, interruption, defect, delay in operation or transmission, communications line failure which is not under its direct control.
    • VIVO ENERGY reserves the right to suspend the CONSUMER PROMO temporarily for operational reasons (e.g. for repairs, planned maintenance or upgrades) whenever it is deemed necessary. VIVO ENERGY promises to restore the PROMO as soon as possible after any temporary suspension period.
  13. Disclaimer of Warranties
    • Participants agree that they participate in the CONSUMER PROMO at their own will and have not been coerced in any manner to enter the promotion. Each participant may opt out of the CONSUMER PROMO and stop receiving any information about the FUELS PROMO.
    • VIVO ENERGY makes no warranty, implied or express, that any part of the promotion will be uninterrupted and error-free. 
    • Neither VIVO ENERGY nor any of its directors, employees, agents or suppliers shall accept any responsibility for any damage, loss, injury or disappointment suffered by any participant in the promotion or as a result of accepting the prize. 
  14. Data protection and Publicity
    • The winners authorize the use by VIVO ENERGY, of their names, photographs and images in any promotional demonstration related to the promotion.
    • Participants agree that if they win a prize their names and phone number will be published for informational purposes only.
    • VIVO ENERGY Ghana may disclose participants’ personal information to its contractors or agents to assist in conducting this promotion or any future promotions.
  15. Miscellaneous
    • VIVO ENERGY reserves the right to cancel or amend the promotion and these Terms and Conditions at any time. Any amendments to the promotion and these terms and conditions shall be made available to motorists. 
    • In the event of dispute regarding the interpretation of the Terms and Conditions, conduct, results, and all other matters relating to the FUELS PROMO the decision of VIVO ENERGY shall be final and without appeal.
    • These Terms and Conditions will remain in full force and effect while VIVO ENERGY provides the offer (not taking into account temporary suspensions of the offer for operational reasons, e.g. for repairs, planned maintenance or upgrades).
